Pub cleared of drive-death blame

The Motor Accidents Insurance Board of Tasmania and the widow of a man who died in a motorbike accident sued the licensee and proprietor of a pub for breaching five duties of care toward the dead man. The Supreme Court of Tasmania found in favour of the widow and the insurer, but the ruling has been overturned on appeal by the High Court. Contrary to an agreement with the publican, the deceased man had insisted on being given his keys to ride home.
