Rules Regarding Health Insurance Fraud Clarified

The office of general counsel opined that an employer, employee or insurance producer commits fraud if they knowingly submit false information to an insurer, such as misrepresenting the number of eligible employees on an application for group health insurance. Sanctions for fraud include criminal prosecution and civil penalties. Moreover, an insurer that fails to investigate the bona fides of the group may also be subject to discipline by the insurance department. OGC Opinion No. 08-11-02.
