Court to inform affected by flooding from hurricanes Katrina and Rita - About Class Action Settlement NEW ORLEANS, January 5
NEW ORLEANS, January 5 / PRNewswire / - A notification of a proposed partial settlement began today as ordered by Judge Stanwood R. Duval, Jr., in the United States District Court, Eastern District of Louisiana to alert those affected by floods due to a spill or failure of the dikes that have taken place in the parish of Jefferson, Orleans, Plaquemines and St. Bernard, Louisiana resulting from Hurricane Katrina and / or Hurricane Rita.
Transactions: the Orleans Levee District, Board of Commissioners of the Orleans Levee District, the Lake Borgne Levee District, Board of Commissioners of the Lake Borgne Levee District, the East Jefferson Levee District, the Board of Levee Commissioners of the Eastern District of Jefferson, their insurer, and all people. The parties include the Released Transactions, and the Board of Commissioners of protection against flooding in Louisiana South-East of the Authority, the protection against flooding in Louisiana South-East of the Authority, and their insurers and all people.
The lawsuit alleges the dikes and flooding and other structures do not control the water and / or have been overcome in the wake of hurricanes Katrina and Rita, because they were not well designed, an inspection, or maintained, and that such breach caused the loss of property, property damage and injuries. Transactions that the dikes have not for reasons beyond their control and they did nothing wrong.
The class includes any person who (a) at the time of Hurricane Katrina and / or Rita: (1) has lived or has been located in the parish of Jefferson, Orleans, Plaquemines or St. Bernard, Louisiana ( "Hurricane Affected Area") or (2) the ownership, location, owned, used or has an interest in all homes, businesses or other property in the hurricane affected area, and (b) has losses, damages, and / or injuries from Hurricane Katrina and / or Hurricane Rita who have been the result of any allegation of non-emergence and / or water or from materials found on, under or through the dikes that have been under the authority or control of the Transactions.
The class was divided into two sub-classes. May the people be included in one or more subclass. Subclasses include any person who has or May have claims against: Diagram 1 - the Lake Borgne Levee District, the Lake Borgne Levee Board of Commissioners District, and / or its insurer, the subclass 2 - Closure of the Eastern District of Jefferson, East Jefferson Levee Board of Commissioners District, and / or its insurer, and subclass 3 - Orleans Levee District, the Orleans Levee Board of Commissioners District and / or their insurer.
Under the settlement, a settlement fund of approximately $ 20.8 million will be established for the benefit of the class settlement, and to cover costs. In accordance with the law, the settlement class may have no other funds or assets in this regulation because the Rules of the defendants are government agencies.
Notices informing members of the class settlement of their rights will be mailed, and is scheduled to appear in local newspapers which led to hearings on 2 April 2009, when the Court will decide whether to approve or certify the settlement class and, if so, whether to grant final approval of the settlement. Hearings May be moved to another date or time without notice
If the settlement is approved, the Court appoints a "special master" to oversee the settlement fund.
